Please read this document carefully. By signing it, you are giving up certain legal rights.
In consideration of being permitted to participate in the charter boating, snorkeling, swimming, and related activities provided by Cayman Luxury Sea Tours (hereinafter referred to as "The Company"), I, the undersigned participant, agree to the following:
1. ASSUMPTION OF RISK: I understand that boating and water-related activities involve inherent risks, dangers, and hazards that cannot be eliminated, including but not limited to:
- Sudden or rough weather conditions and sea state.
- Slippery decks, wet surfaces, and moving equipment.
- Boarding and disembarking the vessel.
- Encounters with marine life (including Stingrays, Jellyfish, etc.), which are wild animals and can bite or sting.
- Physical exertion involved in swimming or snorkeling.
I acknowledge that I am voluntarily participating in these activities with knowledge of the dangers involved, and I agree to accept and assume any and all risks of injury, death, or property damage.
2. RELEASE OF LIABILITY: I hereby release, waive, discharge, and covenant not to sue Bantham Bay Ventures Limited t/a Cayman Luxury Sea Tours, its owners, captains, crew, agents, and employees from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the releasees or otherwise.
3. HEALTH AND PHYSICAL CONDITION: I confirm that I am in good physical health and do not suffer from any medical condition that would prevent me from safely participating in boating or snorkeling activities. I confirm that I am a competent swimmer.
4. ALCOHOL AND BEHAVIOR POLICY: I acknowledge that the consumption of alcohol is permitted on board solely at the discretion of the Captain. I agree to consume alcohol responsibly and acknowledge that The Company is not liable for any injury or accident resulting from my intoxication.
- I understand that the Captain has the ultimate authority. I agree to follow all safety instructions given by the Captain and Crew.
- I understand that illegal drugs are strictly prohibited on board.
5. WILDLIFE INTERACTION (STINGRAY CITY/STARFISH POINT): I understand that interactions with wildlife, including the Southern Stingrays at Stingray City, involve wild animals. While generally docile, they are unpredictable. I assume the risk of any injury resulting from these interactions and agree to follow the crew's specific instructions regarding how to handle and approach marine life.
6. PHOTOGRAPHY RELEASE: I grant Cayman Luxury Sea Tours permission to use any photographs or video footage taken of me during the charter for marketing and social media purposes without compensation. (If you do not agree, please inform the Captain prior to departure).
7. GOVERNING LAW: This agreement shall be construed in accordance with the laws of the Cayman Islands.
